Terms and Conditions – TikBuy.au

1. About TikBuy.au
TikBuy.au (“we”, “our”, or “the platform”) provides a marketplace service that allows third-party sellers (typically manufacturers or wholesalers) to list products for sale to Australian customers.
TikBuy.au is operated by a sole trader registered in Australia. Except where specifically stated (e.g., group buys), TikBuy.au does not act as the seller, nor do we manufacture, store, or guarantee any third-party products.
2. Your Agreement
By using this website, including browsing, placing orders, or registering as a seller, you agree to these Terms and Conditions. If you do not agree, you must not use the platform.
3. How Orders Work
TikBuy.au facilitates payment between customers and third-party sellers.
Payments are held in escrow until the customer confirms receipt of goods or a reasonable confirmation period has passed.
If no complaint is received within that period, the funds will be released to the seller.
Customers are responsible for inspecting their item immediately upon arrival and must notify TikBuy.au within the review period and provide supporting evidence such as photos or videos if there are any issues.
4. Shipping & Group Buys
Most products are shipped directly from the seller to the customer.
In some cases (e.g., group buys or MOQ bulk deals), orders are shipped first to TikBuy.au for redistribution to customers within Australia.
Estimated delivery times:
- Direct: 10–20 business days
- Group buy: 7–10 business days after batch arrival in Australia
5. Returns & Buyer Protection
We offer a TikBuy Buyer Guarantee:
If your item is not delivered, arrives damaged, or is significantly different from the listing, you’re eligible for a refund.
You must notify us within 5 calendar days of confirmed delivery to pause payment release and initiate a review.
If no complaint is received within 5 days, payment will be automatically released to the seller.
For group buys, this window begins when the item is marked as delivered to you.
6. Limitation of Liability
TikBuy.au is not responsible for product quality, safety, or performance beyond the delivery inspection period.
TikBuy.au is not liable for delays or issues caused by sellers, couriers, customs, or other third parties.
You acknowledge that TikBuy.au is a marketplace platform and not the supplier of goods, except where acting as the redistributor in group buys.
7. Pricing, Errors & Availability
Prices are set by the seller and may change without notice.
TikBuy.au is not liable for listing errors, pricing inaccuracies, or out-of-stock items.
We reserve the right to cancel or refund any order for any reason, including suspected fraud or technical errors.
8. Sellers on TikBuy.au
Sellers must:
- Accurately describe their products
- Fulfill orders in a timely manner
- Respond to buyer issues fairly
TikBuy.au may suspend or remove sellers for violations of these terms or marketplace standards.
9. Privacy
We collect personal information as needed to process orders and provide services.

We do not sell or share your data with third-party marketers.
10. Dispute Resolution
If you have an issue, please contact us first here.
We will attempt to resolve disputes promptly and fairly. You agree not to initiate a chargeback or third-party complaint without first contacting us.
11. Legal Disclaimer
TikBuy.au is operated under an Australian Sole Trader ABN.
By using this site, you acknowledge and agree:
- TikBuy.au is a marketplace platform, not a retailer.
- You will not hold the operator personally liable for product faults, late deliveries, or disputes with sellers.
- Our liability is limited to the scope of our service — namely, processing transactions and offering a buyer guarantee during the inspection window.

13. Seller Responsibilities & Requirements
By listing products on TikBuy.au, sellers agree to the following conditions:
a) Product Listings
- All descriptions must be accurate, truthful, and not misleading.
- Images must represent the actual product.
- Listings must clearly state:
- Product details and specifications
- Delivery timeframe
- Any known usage limitations or region-specific differences
b) Legal Compliance & Australian Standards
- Sellers are responsible for ensuring their products comply with all applicable Australian laws, including:
- Customs regulations
- Consumer product safety standards
- Electrical and electronic device certifications
- Intellectual property laws (no counterfeit goods)
TikBuy.au strictly prohibits the sale of:
- Counterfeit or replica goods
- Products banned or restricted under Australian law
- Products lacking required safety or compliance certifications
c) Consequences
If a product is:
- Seized by Australian Customs
- Identified as counterfeit
- Found to be non-compliant with Australian safety standards
TikBuy.au will issue a full refund to the buyer.
The seller will forfeit the full payment for the order and may be suspended from the platform.
d) Fulfillment & Tracking
- Orders must be shipped within 3 business days unless otherwise agreed.
- A valid tracking number must be provided for every shipment.
- Sellers must promptly notify TikBuy.au of any delays or changes.
e) Cancellations, Returns & Disputes
- Sellers must respond to disputes within 3 business days.
- TikBuy.au may withhold or reverse payment to the seller if the issue is unresolved.
- Sellers agree to cooperate in good faith to resolve disputes, returns, or customs issues.
f) Payment Release
- Payment is held by TikBuy.au and only released when:
- The buyer confirms receipt of goods
- OR the 5-day confirmation window passes without complaint
TikBuy.au reserves the right to delay or cancel payment if:
- No tracking is provided
- A dispute is active
- The product violates any laws or platform standards
g) Prohibited Conduct
Sellers must not:
- List counterfeit, illegal, or unsafe goods
- Use fake branding, certifications, or misleading claims
- Communicate with buyers off-platform to bypass TikBuy.au
- Ship used or damaged items unless clearly described
h) Suspension & Removal
TikBuy.au may suspend or ban sellers who:
- Breach any part of this agreement
- Receive excessive buyer complaints
- Violate customs, IP, or safety laws
14. Shipping & Import Costs
a) Shipping Costs
- Each product listing must clearly state whether shipping is included in the price (“Free Shipping”) or charged separately at checkout.
- If shipping is not included in the price, sellers must:
- Provide an exact flat shipping cost
- Ensure tracking is included in the shipping method
- Clearly communicate delivery timelines
- TikBuy.au reserves the right to adjust how shipping charges are displayed to maintain consistency and buyer trust.
b) Import Duties & Customs
- Orders under AUD $1,000 are generally exempt from import GST and duties when entering Australia.
- For orders over AUD $1,000, the buyer may be contacted by Australian Customs and required to pay applicable GST or import duties before the product is released.
- Sellers must ensure all required customs declarations and documentation are correctly completed to prevent delays.
- TikBuy.au will not be held liable for customs delays, rejections, or extra fees resulting from seller errors or misdeclarations.
c) Buyer Notification
- It is the buyer’s responsibility to understand that:
- High-value orders may attract import charges
- These charges are not included in the product price or shipping fee unless explicitly stated
TikBuy.au may refund buyers in the event that customs seizes or refuses the item due to issues such as non-compliance, undeclared content, or false description, at the seller’s expense (see Section 13).
